1. Agreement to Terms

These Terms of Service (“Terms”) govern your use of the PalmettoGuard LLC mobile application and related services (“Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use of the application immediately.

2. Eligibility

You may only use the PalmettoGuard application if you are an authorized resident, guest, employee, contractor, or security professional associated with a participating community. Unauthorized use is strictly prohibited.

3. User Responsibilities

By using the app, you agree to the following:

• You will only enter accurate and truthful information.
• You will not attempt to bypass or manipulate community security controls.
• You will only authorize guests whom you have a legitimate relationship with.
• You will not misuse the system to access restricted areas or private information.
• You will comply with all HOA and Property Management rules and regulations.

4. Acceptable Use

Users must not engage in activities such as:

• Attempting to gain unauthorized access to community systems or data.
• Tampering with access logs, gate controls, or visitor information.
• Using the app for harassment, surveillance, or any unlawful purpose.
• Reverse-engineering, copying, or modifying the application software.

5. App Functionality and Availability

The PalmettoGuard app is provided on an “as‑is” and “as‑available” basis. While we take reasonable steps to ensure uptime and reliability, we do not guarantee uninterrupted service. Planned maintenance or unforeseen outages may affect availability.

6. Data Collection and Privacy

Your use of the app is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of your information as described in that policy.

7. Third‑Party Services

PalmettoGuard LLC may integrate with third‑party vendors (e.g., cloud hosting, mapping, analytics). We are not responsible for the availability or performance of third‑party services, but we take reasonable steps to ensure their reliability and security.

8. Limitation of Liability

To the fullest extent permitted by law, PalmettoGuard LLC is not liable for:

• Losses resulting from user misuse or unauthorized access.
• Delays, outages, or technical issues affecting app performance.
• Actions taken by HOA staff, Property Managers, or community security teams.
• Incorrect or outdated information provided by users.

PalmettoGuard LLC does not guarantee that the app alone will prevent unauthorized entry or security incidents.

9. Termination

We reserve the right to suspend or terminate access to the Services at any time, with or without notice, if we believe a user has violated these Terms or engaged in suspicious activity that could jeopardize community safety.

10. Updates to These Terms

We may update or modify these Terms from time to time. Material changes will be communicated via email or in‑app notification. Continued use of the app after such updates constitutes acceptance of the revised Terms.
